Terms and Conditions

1. Acceptance of terms

By accessing or using the HairSimulate platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

2. Permitted use

The Service is provided for lawful clinical and business use by registered hair restoration clinics and their authorised staff. You may not:

• Use the Service to store or transmit unlawful content.
• Attempt to reverse-engineer or extract source code.
• Share login credentials between unauthorised users.
• Use the Service in a way that violates applicable healthcare regulations.

3. Clinical disclaimer

HairSimulate is a clinical support tool. Simulations and graft analyses are decision-support aids only and do not constitute medical advice. All clinical decisions remain the sole responsibility of the licensed medical professionals using the platform. HairSimulate does not accept liability for clinical outcomes.

4. Accounts and access

Each clinic is responsible for managing user accounts within its workspace, including assigning appropriate roles and revoking access for departed staff promptly. You are responsible for all activity that occurs under your account.

5. Data ownership

You retain ownership of all patient data and clinic content you upload to the Service. By uploading content, you grant HairSimulate a limited licence to store and process it solely to provide the Service. We do not use your patient data for any other purpose.

6. Credits and payments

Access to simulation, enhancement, and 360° video features is governed by a credit-based system. The following terms apply to all credit purchases:

• One-time purchases. Credit packages are sold as one-time purchases, not subscriptions. Annual packages are paid upfront in full; credits are then released monthly over 12 months at the quantity of your chosen plan. There are no recurring charges unless you explicitly purchase a top-up.
• Credit costs. Each simulation (including reference simulations) and each enhancement consumes 1 credit. Generating a 360° video consumes 5 credits. Credits are deducted automatically upon successful completion of the action.
• Top-ups. Each clinic may purchase one top-up per calendar month. Top-ups are offered at the same credit count and price as the clinic's current plan and are subject to these same terms.
• Expiry. Credits expire 12 months from the date of purchase unless a different expiry period is stated at the time of purchase. Expired credits are forfeited and cannot be reinstated, carried over, or transferred.
• No refunds. All credit purchases are final. Credits have no cash value and are non-refundable under any circumstances, including account termination, unused balance, or service downtime.
• Non-transferable. Credits are issued to a single clinic workspace and cannot be transferred to another clinic or exchanged for other services.
• Internal allocation. Clinic owners and coordinators may distribute credits to team members within the same clinic workspace. This internal allocation does not affect the terms above.

7. Availability

We target 99.5% monthly uptime but do not guarantee uninterrupted availability. Planned maintenance will be communicated in advance. We are not liable for losses arising from downtime beyond our reasonable control.

8. Limitation of liability

To the maximum extent permitted by law, HairSimulate's total liability for any claim arising from these Terms or use of the Service is limited to the fees paid by you in the three months preceding the claim.

9. Termination

Either party may terminate the agreement with 30 days' written notice. We reserve the right to suspend access immediately for material breach of these Terms. Upon termination, your data is retained for 30 days then permanently deleted.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which HairSimulate is registered. Disputes will be resolved through good-faith negotiation before any formal proceedings.
